1 - Definitions

Client: Any professional or natural person as understood within the meaning of articles 1123 and thereafter of the Civil Code, or any legal person, visiting the Site and therefore subject to these general conditions.

The Site :

Service: offers clients kinesiology, well-being and personal development services.

Content: All elements constituting the information presented on the Site, notably texts and images.

Client information: The Client’s personal information, which may be held by for account management, management of client relations and for analytical and statistical purposes.

User: Internet user connecting and using the website named above.

Personal information: Information which allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies (article 4 of law n° 78-17 of 6th January 1978). The terms “personal data”, “concerned person”, “subcontractor” and “sensitive data” have their meaning defined by the General Data Protection Regulations (GDPR: n° 2016-679).

2 - General terms of use of the site and services on offer

The site constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable International Regulations.

The client may not in any way reuse, transfer or exploit for his/her own purposes all or part of the elements or works of the Site.

Use of the Site implies full acceptance of the general conditions of use described below.

These conditions of use may be modified or supplemented at any time. Users of the Site are therefore invited to consult them on a regular basis.

This website is normally accessible to users at any time. However, an interruption due to technical maintenance may be decided upon by the site manager, who will endeavour to communicate the dates and times of the intervention to users in advance.

The website is regularly updated by the Publication Manager. Likewise, the legal notices may be modified at any time. They are nevertheless binding for the User who should refer to them frequently to remain up to date.

3 - Description of services provided

The website aims to provide information concerning the general activities of the company.

The publication manager endeavours to provide accurate information on the site, yet cannot be held responsible for omissions, inaccuracies and shortcomings in any updates, whether made by herself or a third party partner who provides her with such information.

All the information provided on the site is intended for information only and is subject to change. Furthermore, the information on the site is not exhaustive, and is subject to modifications being made since being available online.

4 - Contractual limitations on technical data

The site cannot be held responsible for material damage linked to the use of the site. Likewise, the user of the site agrees to access the site using recent equipment, not containing viruses and with an up to date, latest generation browser.

The site is hosted by a service provider on the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: n° 2016-679). The aim is to provide a service that ensures a high rate of accessibility.

The host ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible duration, usually for the purposes of maintenance, infrastructure improvement or failure, or should the services used generate traffic deemed abnormal.

The publication manager and the host cannot be held responsible in the event of malfunction of the internet network, telephone lines or computer or telephone equipment linked to network congestion preventing access to the server.

5 - Intellectual property and counterfeits

Candice Braas is the owner of the intellectual property rights and holds the rights of use on all the elements accessible on the website, specifically the text, images, graphics, logos, videos, icons and sounds. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited, except with the prior written authorisation of the site’s publication manager. Any unauthorised use of the site or any of the content contained within will be considered as constituting an infringement and prosecuted in accordance with the provisions of Intellectual Property Code, legal articles L.335-2 and thereafter.

6 - Limitations of liability

The publication manager acts as editor of the site and is responsible for the quality and veracity of the content published.

The publication manager can not be held responsible for direct and indirect damage caused to the user’s equipment, when accessing the website and resulting either from the use of equipment not responding to the specifications indicated in point 4, or from a bug or incompatibility issue.

Interactive areas (possibility of sending messages from the contact page) are available to users. The publication manager reserves the right to delete, without prior notice, any content posted in this space that would contravene the legislation applicable in Luxembourg, notably the provisions relating to data protection. Where appropriate, she also reserves the right to implead the user’s civil and/or criminal liability, in particular in the event of a racist, abusive, defamatory or pornographic message, regardless of the medium used (text, photography…).

7 - Notification of an issue

Despite considerable efforts, no method of transmission on the Internet, and no method of electronic storage, is completely secure. We therefore cannot guarantee total security. If we become aware of a security breach, we will notify affected users so that they can take appropriate action. Our incident notification procedures take into account our legal obligations, whether at national or European level. We are committed to fully informing our clients of all matters relating to the security of their account and to providing them with all the information necessary to help them comply with their own regulatory reporting obligations. No personal information of the user of the site is published without the knowledge of the user, exchanged, transferred, assigned or sold via any medium whatsoever to third parties. Only the redemption of ownership of the site and its rights would allow the transmission of aforementioned information to the prospective purchaser, who would in turn be bound by the same obligations to store and process data of the users of the site.

8 - Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, the publication manager uses networks with standard security functions such as firewalls, aliases, encryption and passwords.

When processing Personal Data, the publication manager takes all reasonable measures aiming to protect data from loss, misuse, unauthorised access, disclosure, alteration or destruction.

9 - Applicable law and attribution of jurisdiction

Any dispute in connected with the use of the site is subject to Luxembourg law.
